ThemaintargetsoftheInstitutionareensuringsafenavigationandprotectionofmarineenvironmentfromthepollutioninthewaterareaoftheNorthernsearoute.俄羅斯聯(lián)邦國家機構(gòu)“北方海航道管理局”是根據(jù)該俄羅斯聯(lián)邦的政府令№358-P（2013.3.15），聯(lián)邦法律№81（1999.4.30）第3頁5.1款“俄羅斯聯(lián)邦商船航運法”之規(guī)定來組建而成的，主要負責(zé)組織北方海水域的船舶航行。北方海航道管理局的主要職責(zé)就是確保北方海水域航行安全，防止水域污染。Themainfunctionsarethefollowing:ObtainingandconsideringthesubmittedapplicationsandissuingthepermissionsfornavigationthroughtheNorthernsearoute;IssuingthecertificatesoftheiceconventionalpilotageontheNorthernsearoute;Researchingweather,ice,navigationalandotherconditionsontheNorthernsearoute;CoordinationofinstallationofnavigationalaidsandharmonizationofregionstocarryouthydrographicsurveysoperationsontheNorthernsearoute;AssistanceintheorganizationofsearchandrescueoperationsinthewaterareaoftheNorthernsearoute;Assistanceineliminatingtheconsequencesofpollutionfromvesselsofharmfulsubstances,sewageorgarbage;RenderingtheinformationservicesinrelationtothewaterareaoftheNorthernsearoute,forexample,abouttheorganizationofnavigation,requirementsofsafenavigationandothers;MakingrecommendationsaboutdevelopmentofroutesofnavigationandusingicebreakingfleetinthewaterareaoftheNorthernsearoute,iceandnavigationalconditionsthere;TimelydataretrievalfromRussianhydrometeorologicalserviceabouthydrometeorologicalforecastandiceanalysis.主要職能如下：?獲取和考慮申請者提交的申請，并簽發(fā)通過北方海水域船舶航行許可;?簽發(fā)北方海航線常規(guī)冰區(qū)引航的證書;?收集北方海水域天氣、冰、航行和其他情況;?協(xié)調(diào)安裝助航設(shè)施和協(xié)調(diào)地區(qū)開展北方海水域水文測量;?協(xié)助做好北方海水域搜尋和救助工作;?協(xié)助做好清除船舶有害物質(zhì)，污水或垃圾污染;?提供北方海水域的相關(guān)信息服務(wù)。例如，航行組織，航行安全要求以及其他要求；?依靠在北方海水域的冰、航行條件以及破冰船隊等優(yōu)勢，發(fā)布關(guān)于航行路線研究的建議;?提供從俄羅斯水文氣象服務(wù)數(shù)據(jù)庫得到的給予水文氣象預(yù)報和冰分析的及時的數(shù)據(jù)檢索。Legislation法律MarinetransportationontheNorthernSeaRouteisregulatedbythelegislationbasedontheprinciplesoftheUNConventionontheLawoftheSea,1982,inparticulararticle234“Ice-coveredAreas”.Thisarticleauthorizesthecoastalstateswithintheexclusiveeconomiczonetoadoptandenforcethenon-discriminatorylawsandregulationsforpreventionandmonitoringofmarinepollutionfromvesselsintheareascoveredwithiceformostoftheyear.Insummer2012RussianFederationadoptedNewFederalLowonAmendmentstospecificlegislativeactsoftheRussianFederationrelatedtoGovernmentalregulationofmerchantshippinginthewaterareaoftheNothernSeaRoute.BasedonFederalLowinJanuary2013MinistryofTransportofRussianFederationdevelopedandapprovedNewRulesofNavigationintheNorthernSeaRoutewaterarea.ThisdocumentwasregisteredattheMinistryofJusticeofRussiaon12thofApril2013.Since15thofApril2013theofficialwebpageofnewNSRAdministration

isupandrunning.北方海水域的航運管理規(guī)定來源于由1982年聯(lián)合國海洋法公約的第234條“冰封區(qū)域”。該條款授權(quán)專屬經(jīng)濟區(qū)內(nèi)的沿海國家，制訂和執(zhí)行非歧視性的法律和規(guī)章，以防止、減少和控制船只在專屬經(jīng)濟區(qū)范圍內(nèi)冰封區(qū)域船舶對海洋的污染。2012年夏天，俄羅斯聯(lián)邦通過了新的聯(lián)邦法案修正案，對北方海水域商船航行采取了特殊的俄羅斯聯(lián)邦立法予以監(jiān)管。依據(jù)2013年1月聯(lián)邦法案，俄羅斯聯(lián)邦交通運輸部制訂了北方海航道水域新的航行規(guī)則。該規(guī)則在2013年4月12日由俄羅斯司法部簽發(fā)實施。2013年4月15日，新NSR管理的www.NSRA.ru官方網(wǎng)頁啟動并運行。HowtoGetPermit如何得到許可ReferringtoRulesofnavigationinthewaterareaoftheNorthernSeaRoute2013andinformationfromofficialNSRAdministrationwebpage

www.nsra.ru請參考2013年北方海航道航行規(guī)則和NSR的官方網(wǎng)站www.nsra.ruProceduresofnavigationarrangementintheNorthernSeaRoutewaterareaAccordingtotheMSCClause51Item3,arrangementofnavigationintheNorthernSeaRoutewaterareaiscarriedoutbytheNorthernSeaRouteAdministrationestablishedasaFederalState-ownedInstitution(hereinafter,NSRAdministration).北方海航道水域航行管理程序根據(jù)MSC法案第51條3款之要求，北方海航道管理局作為聯(lián)邦政府直屬機構(gòu)對北方海航道航行實施監(jiān)管。Permit-basedprocedureisestablishedfornavigationintheNorthernSeaRoutewaterarea.許可程序主要是規(guī)范北方海航道水域航行。PermitsfornavigationofavesselintheNorthernSeaRoutewaterarea(hereinafter,thepermits)areissuedbytheNSRAdministrationbasedonapplicationfromtheshipowner,arepresentativeoftheshipownerorcaptainoftheship(hereinafterreferredtoastheapplication),whichcontainsdataabouttheapplicant,indicatingthefullnameand(ifapplicable)identificationcodeoftheInternationalMaritimeOrganization(IMOnumber),thesurname,name,patronymic(ifany)ofthechiefofficer,contactphonenumber,faxnumber,e-mailaddressforthelegalpersonorthesurname,name,patronymic(ifany),phonenumber,faxnumber,e-mailaddressfortheindividual.TheapplicationmustcontainstatementthattheshipownerwillensurethattheshipconformtooftheseRulespriortoenteringintheNorthernSeaRoutewaterarea.北方海航道水域的航行許可由北方海航道管理局實施，主要依據(jù)船東、船東代表、船長提出申請，申請數(shù)據(jù)包括船名、IMO編號、大副的姓、名，聯(lián)系電話、傳真、E-MAIL地址等。申請必須包括船長承諾，確保船舶在進入北方海航道水域前遵守相關(guān)規(guī)定要求。1)Informationonthevesselandthevoyageinaccordancewith

twoworkingdaysafterthedecisionismade,specifyingthefollowing:北方海航道管理局應(yīng)作出一個決定許可船舶通過北方海航道水域。該許可應(yīng)在作出決定后的兩天內(nèi)公布在官方網(wǎng)站，詳細情況如下：1)Thenameofthevesselreceivingthepermit;

2)Theflagofthevesselreceivingthepermit;

3)IMOnumberofvesselreceivingthepermit;

4)Dateofthepermitcomingintoforceandexpirationdate(theeffectiveperiodofthepermitshallnotexceed365calendardays);

5)Thevessel’srouteofvoyage(areaofoperation)theNorthernSeaRoutewaterarea;

6)Theinformationoftheneedforicebreakersupportinheavy,mediumandlighticeconditions,indicatingthewaterarea(s)oftheNorthernSeaRoute(South-westernpartoftheKaraSea,thenorth-easternpartoftheKaraSea,thewesternpartoftheEastSiberianSea,theeasternpartoftheEastSiberianSea,thewesternpartoftheLaptevsea,theeasternpartoftheLaptevsea,theChukchiSea),andthenavigationperiod,specifiedintheAppendix2totheseRuleswhenthevesselshallnavigatewithicebreakersupport.1）許可船舶的船名2）許可船舶的國籍3）許可船舶的IMO編號4）許可通過的日期和實效期限（許可通過的期限不超過365天）5）船舶通過北方海航道水域的航行6）在重冰、中型冰和輕冰條件下需要破冰船支持的信息，并標(biāo)明北方海航道海域信息：喀拉海的西南部分，喀拉海的東北部，東西伯利亞海的西部，東西伯利亞海的東部，拉普捷夫海的西部、拉普捷夫海的東部，楚科奇海，以及航行日期。當(dāng)船舶需要破冰船輔助航行時，這些信息詳細規(guī)定在規(guī)則在附錄2中。Apermitmayberefusedforthefollowingreasons:拒絕許可的原因如下：1)theinformationreferredtointhestatementand/ordocumentsandpapers,isfalseormisleading;

2)FailuretoprovideorincompletesubmissionofthedocumentsandinformationasperItems4and5oftheRules;

?Waystomaintainsafespeedanddistancetotheicebreakeroranothervesselaheadwhileproceedinginanicecaravan;

?Waystofulfillinstructionsreceivedfromtheicebreakerperformingicebreakersupport.在冰區(qū)引航過程中，冰區(qū)引航員可以給船長提供如下建議：冰情的評估，及在當(dāng)前條件下船舶安全航行的概率；在未結(jié)冰水域、船舶獨立航行期間，給船舶選擇一條最優(yōu)航線以及最適當(dāng)?shù)拇昂叫蟹桨?；為船舶選擇最優(yōu)的速度和航路，以避免船體和動力系統(tǒng)、操縱系統(tǒng)與冰之間碰撞產(chǎn)生的危險；當(dāng)在破冰船隊中航行時，提供與破冰船和其他船舶保持安全航速和安全距離的建議；實現(xiàn)從破冰船接收指令、執(zhí)行破冰船的支持的方法Toperformicepilotage,theicepilotistohaveathisdisposalthefollowingtechnicalequipmentandmaterials:1)SeanavigationchartsandguidelinesfortheNorthernSeaRoutewaterarea,correctedaccordingtothelatestNoticestoMariners;

2)Navigational,hydro-meteorologicalandhydrologicalinformationontheNorthernSeaRoutewaterarea;

3)WarmspecialclothingaccordingtotheclimateconditionsoftheNorthernSeaRoutewaterarea.實施冰區(qū)引航，冰區(qū)引航員有權(quán)要求提供如下信息：1）海圖，北方海航道水域航行指南，并根據(jù)最新航海通告實施改正；2）北方海航道水域航行、水文信息；3）根據(jù)北方海航道水域的天氣條件，接受特殊的氣息預(yù)報Inthecourseoficepilotagetheicepilotshallhavetheright:1)Tousethevessel’sradiostationandothermeansofcommunication;

2)Touseallthenavigationequipmentandauxiliarydevicesofthevessel;;

3)Toreceivefromthevessel’smasterinformationonstructuralandoperationalpeculiaritiesofthevessel,aswellasonthecurrentstatusofnavigationinstruments,propulsionsystem,steering,thrusting,anchor,andothersystemsresponsibleforthevessel’ssteeringandmaneuvering;

4)

Toreceivefromthevessel’smasterinformationonthevessel’sname,herdescription(length,breadth,draft,mastheightabovethewater,speed,auxiliarythrusters),callsigns,dataonthedraft,loading,stability,andresistancetoflooding;

在冰區(qū)引航過程中，冰區(qū)引航員有如下權(quán)利：1）使用船舶無線電臺和其他通訊工具；2）使用船舶所有的航行設(shè)和輔助設(shè)施；3）接收船長提供的船舶結(jié)構(gòu)和操縱性能參數(shù)，以及與船舶操縱相關(guān)的航行設(shè)備、推進系統(tǒng)、舵系統(tǒng)、側(cè)推系統(tǒng)、錨系統(tǒng)以及其他系統(tǒng)的當(dāng)前狀態(tài)；4）接受船長提供的其他信息，包括船名、船舶參數(shù)（長、寬、吃水、水線面高度、航速和側(cè)推），呼號、四面吃水、裝載量、穩(wěn)性和抗沉性。Beforethecommencementoficepilotagetheicepilotshallbeobliged:1)Onthearrivalaboardshiptoshowtoshipmasteracertificate;

2)TohavetheplanofforthcomingtripthroughtheNorthernSeaRoutewaterareaapprovedbythevessel’smaster;

4)Tohaveapprovedbythevessel’smastertheproceduresofforwardinginformationanddirectionsrelatedtothevesselcontrol,aswellascontrolofconsequencesofsuchdirectionsfulfillmentintheprocessofforthcomingicepilotage;
