vehicleexports.6Ofthecarssold,4.58millionweresolddomesticallyand1.11millionwereexported,ayear-on-year(y-o-y)increaseof6.2percentand34.3percentrespectively.7Duringthisperiod,themarketshareofdomesticpassengercarmanufacturersgrewto59.6percent,anincreaseof7.4percentagepoints.8

Themanufactureandexportofcommercialvehiclesalsoincreasedinthefirstquarterof2024.Productionreached997,000units,ay-o-yincreaseof5.1percent.9Ofthevehiclessold,819,000weresolddomestically,a6.3percentincreasey-o-y,and214,000wereexportedtoothermarkets,ay-o-yincreaseof27.5percent.10

Thenew-energyvehicle(NEV)marketfordomesticpurchaseisgrowingfasterthanthatforexport.Duringthefirstquarterof2024,1.78millionNEVsweresolddomestically,a33.3percenty-o-yincrease,whileonly307,000wereexportedtoothermarkets,a23.8percentincreasey-o-y.AsofMarch2024,NEVshelda31.1percentshareinChina’sautomotivemarket.11

RegulatoryDevelopments

InSeptember2023,theMinistryofIndustryandInformationTechnology(MIIT)releaseditsWorkPlanforStableGrowthintheAutomotiveIndustry(2023–2024).12TheplanisaimedatexpandingtheconsumptionofNEVs,stabilisingconsumptionlevelsforinternalcombustion(IC)vehicles,promotingexportsandencouragingthescrappingofoldvehicles.However,nofurtherdetailshavebeenreleasedontheimplementationofthesegoals.InDecember2023,theMIITalsoissuedtheGreenandLow-CarbonDevelopmentRoadmapfortheAutomotiveIndustry1.0.13TheroadmapintegratesthefocusonNEVtechnologydevelopmentwiththecountry’s30/60Goals.14Similarly,thereisstillnospecificguidanceonhowtorealisethetargetsproposedbythedocument.

Therewasnotasignificantopeningupofautonomousdrivingregulationsin2023,buttherewasanotableincreaseintheprevalenceofautonomousvehiclepilotprogrammesacrossChina.15&16Anothernoteworthydevelopmentwasthereleaseofdraftregulationsonbatterycapacity,oneofthefirststepsChinahastakentoaddressovercapacityintheautomotiveindustry.17Whilethedraftclaimstorestrictprojectsaimedonlyatexpandingproductioncapacityandencouragesbatteryproducerstoimprovebatteryquality,itwilllikelyhavelittleimpactinpractice.Underthenewregulations,companieswillbeencouragedtoallotaminimumofthreepercentoftheirrevenuetoresearchanddevelopment(R&D)andtechnologicalupgrades,18butthisisfarlowerthantheexistingR&Dexpenditureofmostmanufacturers.Furthermore,theEVbatteryqualitystandardsproposedbythedraftarestillsignificantlylowerthanthosealreadymetbymostEVbatteriesonthemarket.

FurtherunderscoringtheincreasingimportanceofEVbatteries,theEuropeanUnion(EU)becamethefirstmajormarkettointroduceamandatorybatterycarbonfootprintcalculationmethodology,19withothermarkets,includingChina,expectedtoreleasetheirownrequirementssoon.

Inthepast,Chinaonlyallowedforeign-investedenterprises(FIEs)totakepartinvehiclemanufacturingthroughjointventures(JVs)withChinesecompanies.Theserestrictionswereliftedfrom1stJanuary2022,20&21providingafullyopenmarketintheory.However,inpractice,foreign-investedvehiclemanufacturersstillfaceregulatorybarriersthatpreventthemfromoptimisingtheirinvestmentsinChina,includingthroughtherestructuringofexistingoperations,adjustingtheforeignequityratioofexistingJVsandbuildingnewvehicleproductionplants.

InadditiontotheProvisionsontheAdministrationofInvestmentsintheAutomotiveIndustry,22internaldocumentsandproceduresthatarenotpubliclyavailableregulatetheapprovalofvehiclemanufacturingrelatedinvestments.ThiscreatesanopaqueregulatoryenvironmentinwhichFIEsareunabletofullyunderstandtherulesthatgovernthem;theuncertaintythatthisresultsinpreventsthemfrombeingabletomakelong-terminvestmentdecisions.Torebuildconfidenceintheindustry,itisrecommendedthattheauthoritiesensurethatthesebarriersareeithercompletelyremovedorofficiallyclarifiedinordertocreateatransparentandpredictableregulatoryframework.

Thethreehighest-leveldatalawspertainingtodatasecurityinChina,theCybersecurityLaw,theDataSecurityLawandthePersonalInformationProtectionLaw,havealreadycomeintoforce.23&24&25InMarch2024,theCyberspaceAdministrationofChina(CAC)announcedtheProvisionsonPromotingandRegulatingCross-borderFlowofData(ProvisionsonCross-borderData),26aimedatoptimisingdataexportsystemssuchasthedataexportsecurityassessment,thestandardcontractfortheexportofpersonalinformationandpersonalinformationprotectioncertification.However,despitethisincreasinglymaturecross-borderdatatransferregulatoryframeworkandthedirectiongivenbytheOpinionsonFurtherOptimisingtheForeignInvestmentEnvironmentandIncreasingEffortstoAttractForeignInvestmentOpinionstomakeCBDTmoreconvenient,27theautomotiveindustryisstillunabletoconductindustry-standardcross-borderdatatransfer(CBDT)inanefficientmanner.

Personalinformationandvehicledataareneededforbothbusinessdevelopmentandresearchanddevelopment(R&D).Theyalsoplayanessentialroleinallowingcompaniestoprovidethebestpossiblecustomerserviceexperiencefordrivers,especiallyforimportedvehicles.Immediateremoteassistancefromengineersoutsidethecountryisoftenrequiredtoanalyseandsolveproblemsunderemergencycircumstances,suchascaraccidents.EvenifaccidentdatawasnotclassifiedasimportantpersonaldatabytheProvisionsonAutomobileData,automotivemanufacturerswouldstillbeunabletotransferthedatainmostcasesduetoitbeingthesubjectofaninvestigation.Thesemultiplelayersofrestrictionsfurtherunderscorewhytheautomotiveindustryneedsamorepracticalapproachtoregulatingdata,whichisalreadysubjecttoavarietyofprotections,suchasdatamaskingandothersecurityprotocols.ThecurrentCBDTrestrictionsserveonlyasabureaucraticbarriertocustomersreceivingtimelyinformationabouttheircars,whiledoingnothingtoincreaseprivacyinpractice.Awhitelistthatwouldallowkeytypesofdata,suchasaccidentdata,tobeexportedimmediatelyforcustomerservicepurposeswouldgoalongwaytowardsimprovingthissituation.29Furthermore,thewhitelistshouldincludebothbusinessdevelopmentandR&DdatasothatChinacancontinuetobeaglobalcentreofautomobileinnovation.Itisimportantthatevenifimprovementsaremade,regulatorscontinuetoevaluatethereasonsfordatatransferandusageandensurethatregulationreflectsanunderstandingofthis.

ThebestwayforChineseauthoritiestoachievethisistoactivelycommunicateandcoordinatewithindustryplayers,includinginternationalautomotivecompanies,whenformulatingandimplementingrelatedpolicies.CBDTandotherdatapoliciesneedtobewellformulated,scientific,practicallyimplementableandspecificinordertoallowChineseconsumerstoreceivethebestpossibleserviceexperienceandforChinatocontinuetoattractinvestmentfrominternationalautomotivemanufacturers.

Rulesfordualcreditsafter2025havenotyetbeenreleased,30whichmayimpactsustainabledevelopmentoftheautomotiveindustry,asmanufacturersrequireastableandpredictableregulatoryenvironmenttoplanproductionschedules.Beforesettingrules,fullconsultationwiththeindustryisnecessarytoavoidsettingeitheroverlyaggressivegoalsorimpracticaltransitionperiods.WhiletheNEVDevelopmentPlan2021–2035outlinesaproposaltoconnectChina’sdualcreditpolicywithitsemissionstradingsystem(ETS),31detailsonhowtheywillbeintegratedarenotyetinplace.Clarifyingthedetailsasearlyaspossibleisnecessarytogivemanufacturersthetimetheyneedtoachievecompliance.

Vehicleenergyconsumptionstandards

Existingstandardsregulateaverageenergyusageacrosstheentirefleetofautomotivemanufacturers’BEVs,ratherthanmodelbymodel.32&33Thismethodtakesintoaccountthatsomehigh-performancecarsthatuseahigheramountofenergyaresoldinverylowquantities,meaningthatautomotivemanufacturerscansellthesevehicles,providedtheysellasufficientquantityofvehicleswithalowerlevelofenergyusetobringdowntheiraverage.Whilehigh-performancevehiclesmakeupasmallnumberofvehiclesontheroad,theyareakeypartofthetransitionfromICvehiclestoBEVs.Thedevelopmentofhigh-performanceBEVsprovidesconsumerswithmorechoicesanddemonstratesthatEVtechnologycancompetewithICtechnologyinhigh-performancesettings.IntroducingsinglevehicletargetsforBEVswoulddiscouragethedevelopmentofhigh-performanceBEVs,givinganupperhandtoexistingICvehicles,anddolittletoreduceon-roadenergyconsumptionoverall.
