中英文家政服務(wù)合同范本合同雙方身份信息甲方(雇主)姓名:[雇主姓名]國(guó)籍:[雇主國(guó)籍]證件類型及號(hào)碼:[具體證件號(hào)碼]聯(lián)系地址:[詳細(xì)地址]聯(lián)系電話:[電話號(hào)碼]乙方(家政服務(wù)機(jī)構(gòu))名稱:[家政服務(wù)機(jī)構(gòu)名稱]法定代表人:[法定代表人姓名]統(tǒng)一社會(huì)信用代碼:[代碼編號(hào)]注冊(cè)地址:[注冊(cè)地址]聯(lián)系電話:[聯(lián)系電話]鑒于甲方有家政服務(wù)需求,乙方具備提供家政服務(wù)的資質(zhì)和能力,雙方根據(jù)《中華人民共和國(guó)民法典》及相關(guān)法律法規(guī)的規(guī)定,經(jīng)平等、自愿、協(xié)商一致,就家政服務(wù)事宜達(dá)成如下協(xié)議。服務(wù)內(nèi)容及要求服務(wù)內(nèi)容乙方應(yīng)按照甲方的要求,為甲方提供以下家政服務(wù):1.家庭清潔:包括但不限于客廳、臥室、廚房、衛(wèi)生間等各個(gè)房間的地面、墻面、家具表面的清潔,窗戶玻璃的擦拭,廚房爐灶、抽油煙機(jī)等廚具的深度清潔,衛(wèi)生間馬桶、浴室柜等潔具的消毒清潔。2.烹飪服務(wù):根據(jù)甲方提供的食材和口味要求,為甲方準(zhǔn)備一日三餐,包括中餐和晚餐,也可根據(jù)甲方需求提供早餐。烹飪的菜品應(yīng)注重營(yíng)養(yǎng)搭配和口味多樣。3.衣物洗滌與熨燙:分類清洗甲方的各類衣物,包括機(jī)洗和手洗,對(duì)于需要熨燙的衣物進(jìn)行熨燙整理,確保衣物干凈、平整。4.照顧老人/兒童:如果甲方有老人或兒童需要照顧,乙方應(yīng)安排具有相應(yīng)經(jīng)驗(yàn)和技能的服務(wù)人員,為老人提供生活照料,如協(xié)助進(jìn)食、穿衣、洗澡等,陪伴老人聊天、散步等;為兒童提供日常生活護(hù)理,如喂食、哄睡、陪玩等,同時(shí)注重兒童的安全和教育。服務(wù)要求1.乙方提供的服務(wù)人員應(yīng)具備相應(yīng)的專業(yè)技能和良好的職業(yè)道德,身體健康,無傳染性疾病和不良記錄。2.服務(wù)人員應(yīng)嚴(yán)格遵守甲方的家庭規(guī)章制度,尊重甲方的生活習(xí)慣和隱私。3.服務(wù)過程中應(yīng)使用符合安全和環(huán)保要求的清潔用品和工具。4.乙方應(yīng)定期對(duì)服務(wù)人員進(jìn)行培訓(xùn)和管理,確保服務(wù)質(zhì)量的穩(wěn)定和提高。服務(wù)期限本合同服務(wù)期限自[起始日期]起至[結(jié)束日期]止。合同期滿后,雙方如無異議,則自動(dòng)延續(xù)[延續(xù)時(shí)長(zhǎng)]。服務(wù)費(fèi)用及支付方式服務(wù)費(fèi)用甲方應(yīng)向乙方支付的服務(wù)費(fèi)用為每月人民幣[X]元(大寫:[大寫金額])。該費(fèi)用包括乙方服務(wù)人員的工資、乙方的管理費(fèi)用及相關(guān)稅費(fèi)等。支付方式甲方應(yīng)在每月[支付日期]前,將當(dāng)月的服務(wù)費(fèi)用支付至乙方指定的銀行賬戶。乙方應(yīng)在收到款項(xiàng)后[X]個(gè)工作日內(nèi),向甲方提供正規(guī)發(fā)票。雙方權(quán)利和義務(wù)甲方權(quán)利和義務(wù)權(quán)利1.有權(quán)要求乙方按照合同約定的服務(wù)內(nèi)容和要求提供服務(wù)。2.有權(quán)對(duì)乙方服務(wù)人員的工作進(jìn)行監(jiān)督和評(píng)價(jià),如發(fā)現(xiàn)服務(wù)人員不稱職或違反合同約定,有權(quán)要求乙方更換服務(wù)人員。3.有權(quán)了解乙方服務(wù)人員的健康狀況、工作經(jīng)歷等相關(guān)信息。義務(wù)1.按照合同約定的時(shí)間和金額向乙方支付服務(wù)費(fèi)用。2.為乙方服務(wù)人員提供必要的工作條件和生活設(shè)施,如住宿、飲食等(如有需要)。3.向乙方如實(shí)告知服務(wù)需求和相關(guān)家庭情況,不得隱瞞或提供虛假信息。4.尊重乙方服務(wù)人員的人格尊嚴(yán)和勞動(dòng)成果,不得歧視、虐待服務(wù)人員。乙方權(quán)利和義務(wù)權(quán)利1.有權(quán)按照合同約定收取服務(wù)費(fèi)用。2.有權(quán)對(duì)服務(wù)人員進(jìn)行管理和調(diào)配,根據(jù)實(shí)際情況調(diào)整服務(wù)人員的工作安排。3.在服務(wù)過程中,如甲方提出不合理的要求或違反合同約定,乙方有權(quán)提出異議并要求甲方改正。義務(wù)1.按照合同約定的服務(wù)內(nèi)容和要求,為甲方提供優(yōu)質(zhì)、高效的家政服務(wù)。2.負(fù)責(zé)服務(wù)人員的招聘、培訓(xùn)、管理和考核,確保服務(wù)人員具備相應(yīng)的專業(yè)技能和服務(wù)水平。3.為服務(wù)人員購(gòu)買必要的社會(huì)保險(xiǎn)和商業(yè)保險(xiǎn),承擔(dān)服務(wù)人員在工作過程中因意外事故或職業(yè)病等產(chǎn)生的相關(guān)費(fèi)用。4.定期對(duì)服務(wù)質(zhì)量進(jìn)行檢查和評(píng)估,及時(shí)處理甲方的投訴和建議,不斷改進(jìn)服務(wù)質(zhì)量。5.在服務(wù)過程中,保守甲方的商業(yè)秘密和個(gè)人隱私。違約責(zé)任甲方違約責(zé)任1.如甲方未按照合同約定的時(shí)間和金額支付服務(wù)費(fèi)用,每逾期一日,應(yīng)按照未支付金額的[X%]向乙方支付違約金。逾期超過[X]日的,乙方有權(quán)暫停服務(wù)直至甲方支付費(fèi)用及違約金。2.如甲方違反合同約定,給乙方造成損失的,應(yīng)承擔(dān)賠償責(zé)任。乙方違約責(zé)任1.如乙方未按照合同約定的服務(wù)內(nèi)容和要求提供服務(wù),甲方有權(quán)要求乙方限期整改。如乙方在規(guī)定的期限內(nèi)未完成整改或整改后仍不符合要求的,甲方有權(quán)扣除相應(yīng)的服務(wù)費(fèi)用,直至解除合同,并要求乙方按照合同總金額的[X%]向甲方支付違約金。2.如乙方服務(wù)人員在工作過程中給甲方造成人身傷害或財(cái)產(chǎn)損失的,乙方應(yīng)承擔(dān)賠償責(zé)任。3.如乙方違反合同約定,擅自更換服務(wù)人員或減少服務(wù)內(nèi)容,應(yīng)按照合同總金額的[X%]向甲方支付違約金,并應(yīng)及時(shí)恢復(fù)服務(wù)原狀。爭(zhēng)議解決本合同在履行過程中如發(fā)生爭(zhēng)議,雙方應(yīng)首先友好協(xié)商解決;協(xié)商不成的,任何一方均有權(quán)向合同簽訂地有管轄權(quán)的人民法院提起訴訟。其他條款1.本合同自雙方簽字(或蓋章)之日起生效,一式兩份,甲乙雙方各執(zhí)一份,具有同等法律效力。2.本合同未盡事宜,可由雙方另行簽訂補(bǔ)充協(xié)議,補(bǔ)充協(xié)議與本合同具有同等法律效力。甲方(簽字/蓋章):日期:年月日乙方(簽字/蓋章):日期:年月日EnglishVersionoftheDomesticServiceContractI.IdentityInformationofthePartiesPartyA(Employer)Name:[Employer'sName]Nationality:[Employer'sNationality]TypeandNumberofIdentificationDocument:[SpecificIDNumber]ContactAddress:[DetailedAddress]ContactPhoneNumber:[PhoneNumber]PartyB(DomesticServiceAgency)Name:[NameoftheDomesticServiceAgency]LegalRepresentative:[NameoftheLegalRepresentative]UnifiedSocialCreditCode:[CodeNumber]RegisteredAddress:[RegisteredAddress]ContactPhoneNumber:[ContactPhoneNumber]WhereasPartyAhasademandfordomesticservices,andPartyBhasthequalificationandabilitytoprovidesuchservices.InaccordancewiththeprovisionsoftheCivilCodeofthePeople'sRepublicofChinaandrelevantlawsandregulations,throughequal,voluntaryandconsensusbasednegotiation,thetwopartiesherebyreachthefollowingagreementondomesticservices.II.ServiceContentandRequirementsServiceContentPartyBshallprovidethefollowingdomesticservicestoPartyAasrequiredbyPartyA:1.HouseCleaning:Thisincludesbutisnotlimitedtocleaningthefloors,walls,andfurnituresurfacesinvariousroomssuchasthelivingroom,bedrooms,kitchen,andbathroom.Italsoinvolveswipingthewindowglass,deepcleaningkitchenapplianceslikestovesandrangehoods,anddisinfectingandcleaningsanitarywaresuchastoiletsandbathroomvanitiesinthebathroom.2.CookingService:BasedontheingredientsprovidedbyPartyAandtherequiredtaste,PartyBshallpreparethreemealsadayforPartyA,includinglunchanddinner,andcanalsoprovidebreakfastuponPartyA'srequest.Thecookeddishesshallpayattentiontonutritionalbalanceanddiverseflavors.3.LaundryandIroning:PartyBshallsortandwashallkindsofPartyA'sclothes,includingmachinewashingandhandwashing.Forclothesthatneedironing,theyshallbeironedandtidieduptoensuretheyarecleanandflat.4.CaringfortheElderly/Children:IfPartyAhaselderlypeopleorchildrentobetakencareof,PartyBshallarrangeservicepersonnelwithrelevantexperienceandskills.Fortheelderly,theservicepersonnelshallprovidedailylivingcare,suchasassistingwitheating,dressing,andbathing,andaccompanythemforchattingandwalking.Forchildren,theyshallprovidedailycare,suchasfeeding,puttingthemtosleep,andplayingwiththem,whilealsopayingattentiontothechildren'ssafetyandeducation.ServiceRequirements1.TheservicepersonnelprovidedbyPartyBshallhavecorrespondingprofessionalskillsandgoodprofessionalethics.Theyshallbeingoodhealth,freefrominfectiousdiseasesandbadrecords.2.TheservicepersonnelshallstrictlyabidebyPartyA'sfamilyrulesandregulations,respectPartyA'slivinghabitsandprivacy.3.Duringtheserviceprocess,cleaningsuppliesandtoolsthatmeetsafetyandenvironmentalprotectionrequirementsshallbeused.4.PartyBshallregularlytrainandmanagetheservicepersonneltoensurethestabilityandimprovementofservicequality.III.ServiceTermTheservicetermofthiscontractshallbefrom[StartDate]to[EndDate].Aftertheexpirationofthecontract,ifbothpartieshavenoobjections,thecontractshallbeautomaticallyextendedfor[ExtensionDuration].IV.ServiceFeesandPaymentMethodServiceFeesPartyAshallpayPartyBamonthlyservicefeeofRMB[X](inwords:[AmountinChineseCharacters]).ThisfeeincludesthewagesofPartyB'sservicepersonnel,PartyB'smanagementfees,andrelevanttaxes.PaymentMethodPartyAshallpaythemonthlyservicefeetothebankaccountdesignatedbyPartyBbeforethe[PaymentDate]ofeachmonth.PartyBshallissueaformalinvoicetoPartyAwithin[X]workingdaysafterreceivingthepayment.V.RightsandObligationsofthePartiesRightsandObligationsofPartyARights1.PartyAhastherighttorequirePartyBtoprovideservicesinaccordancewiththeservicecontentandrequirementsstipulatedinthecontract.2.PartyAhastherighttosuperviseandevaluatetheworkofPartyB'sservicepersonnel.IfPartyAfindsthattheservicepersonnelareincompetentorviolatethecontract,PartyAhastherighttorequirePartyBtoreplacetheservicepersonnel.3.PartyAhastherighttoknowthehealthstatus,workexperience,andotherrelevantinformationofPartyB'sservicepersonnel.Obligations1.PartyAshallpaytheservicefeestoPartyBontimeandintheamountstipulatedinthecontract.2.PartyAshallprovidenecessaryworkingconditionsandlivingfacilitiesforPartyB'sservicepersonnel,suchasaccommodationandmeals(ifnecessary).3.PartyAshalltruthfullyinformPartyBoftheservicerequirementsandrelevantfamilysituations,andshallnotconcealorprovidefalseinformation.4.PartyAshallrespectthedignityandlaborachievementsofPartyB'sservicepersonnel,andshallnotdiscriminateagainstorabusethem.RightsandObligationsofPartyBRights1.PartyBhastherighttocollectservicefeesinaccordancewiththecontract.2.PartyBhastherighttomanageandallocatetheservicepersonnel,andadjusttheworkarrangementsoftheservicepersonnelaccordingtotheactualsituation.3.Duringtheserviceprocess,ifPartyAputsforwardunreasonablerequirementsorviolatesthecontract,PartyBhastherighttoraiseobjectionsandrequirePartyAtomakecorrections.Obligations1.PartyBshallprovidehighqualityandefficientdomesticservicestoPartyAinaccordancewiththeservicecontentandrequirementsstipulatedinthecontract.2.PartyBshallberesponsiblefortherecruitment,training,management,andassessmentofservicepersonneltoensurethattheyhavecorrespondingprofessionalskillsandservicelevels.3.PartyBshallpurchasenecessarysocialinsuranceandcommercialinsurancefortheservicepersonnel,andbeartherelevantexpensesarisingfromaccidentsoroccupationaldiseasesoftheservicepersonnelduringtheworkprocess.4.PartyBshallregularlyinspectandevaluatetheservicequality,promptlyhandlePartyA'scomplaintsandsuggestions,andcontinuouslyimprovetheservicequality.5.Duringtheserviceprocess,PartyBshallkeepPartyA'sbusinesssecretsandpersonalprivacyconfidential.VI.LiabilityforBreachofContractLiabilityofPartyAforBreachofContract1.IfPartyAfailstopaytheservicefeesontimeandintheamountstipulatedinthecontract,PartyAshallpayapenaltyof[X%]oftheunpaidamounttoPartyBforeachoverdueday.Iftheoverdueperiodexceeds[X]days,PartyBhastherighttosuspendtheserviceuntilPartyApaysthefeesandthepenalty.2.IfPartyAviolatesthecontractandcauseslossestoPartyB,PartyAshallbeartheliabilityforcompensation.LiabilityofPartyBforBreachofContract1.IfPartyBfailstoprovideservicesinaccordancewiththeservicecontentandrequirementsstipulatedinthecontract,PartyAhastherighttorequirePartyBtomakecorrectionswithinatimelimit.IfPartyBfailstocompletethecorrectionswithinthespecifiedtimelimitortheservicestillfailstomeettherequirementsafterthecorrections,PartyAhastherighttodeductthecorrespondingservicefees,andeventerminatethecontract.PartyBshallalsopayapenaltyof[X%]ofthetotalcontractamounttoPartyA.2.IfPartyB'sservicepersonnelcausepersonalinjuryorpropertydamagetoPartyAduringtheworkprocess,PartyBshallbeartheliabilityforcompensation.3.IfPartyBviolates
