The Lump Sum Contract Price shall be the aggregate of: (1) Foreign Currency Portion (amount of foreign currency)

14、 and (2) Local Currency Portion (amount of local currency) The breakdown of the Lump Sum Contract price in accordance with forms is given in Price Schedule Appendix 9 hereto.Within 3 months after Effective Date of Contract, if requested by the Contractor, the Foreign Currency Portion and Local Curre

19、X and/or Consultant for these design meetings are organized in the Contractors head office and participation of XX/Consultant and/or third party (quality control companies) on testing/inspection of major equipments at Contractors workshop. This provisional amount of money which the Contractor will s

20、pend with approval by XX is reimbursable. 27、 Conditions Volume 1 Bidding document, the Contractor shall proceed with the Works in accordance with the time schedule specified in Appendix 4 (Project Implementation Schedule) hereto and shall attain Provisional Acceptance of the MM Coal-fired Thermal Power Plant within 36 months for Unit No.1 and

28、 42 months for Unit No.2 and the whole Plant from the Effective Date of Contract.在不違背招標(biāo)文件第 1 卷的 GC26.2 的規(guī)定的前提下，承包商應(yīng)該根據(jù)附件 4（項(xiàng)目實(shí)施進(jìn)度表）的規(guī)定，在合同生效之日起 36 個(gè)月內(nèi)獲得 MM燃煤火電廠 1 號(hào)機(jī)組的臨時(shí)驗(yàn)收，在合同生效之日起 42 個(gè)月內(nèi)獲得 MM燃煤火電廠 2 號(hào)機(jī)組和整個(gè)電廠的臨時(shí)驗(yàn)收。Time for Possession 進(jìn)場(chǎng)時(shí)間5.3 XX shall give full possession of and accord all rights of

30、Power Plant or any part thereof within the Time for Completion Specified in Article 5.2 (Time for Completion) above or within such extended time to which the Contractor shall be entitled under GC 39 (Extension of Time for Completion) of the General Conditions/Volume 1-ITB, the Contractor shall pay t

31、o XX USD120,000/day x total days of delay for each Unit pursuant to GC26.2 of the General Conditions. Such amount shall be paid as liquidated damages and not exceed ten percents (10%) of Contract Price.如果承包商未能按照條款 5.2（竣工時(shí)間）的規(guī)定時(shí)間獲得MM 燃煤火電廠的臨時(shí)驗(yàn)收，或者根據(jù)第 1 卷（ITB）的 GC39（竣工時(shí)間的延長(zhǎng)）的規(guī)定，在延長(zhǎng)后的擔(dān)保竣工之日仍未獲得 MM 燃煤火電

32、廠的臨時(shí)驗(yàn)收，那么根據(jù) GC26.2 的規(guī)定，從規(guī)定竣工之日起開(kāi)始計(jì)算，承包商應(yīng)該向 XX支付的工期延遲違約賠償金為每臺(tái)機(jī)組 120,000 USD/天，作為延遲違約賠償金支付的金額不得超過(guò)合同總價(jià)格的 10%。5.5 Guarantee Period 保證期The Guarantee Period for the Plant shall be not less than 24 months effective from the date of Provisional Acceptance Unit issued by XX and in accordance with GC27根據(jù) GC27
