betweenthefollowingEmployerandEmployeeinaccordancewiththeLabourLawofPeople'sRepublicofChina?!?.TermoftheContract:Thetermofthiscontractisfor_____yearsandshallcommenceon_____,_____,andshallcontinueuntil_____,_____,unlessearlierterminatedpursuanttothisContract.TheEmployeeshallundergoaprobationaryperiodof___months.2。JobDescription:TheEmployeragreestoemployMr。/Ms.________(name)as________(jobtitle)in________Department,locatedin________(officelocationandcity).3。RemunerationofLaboura.ThesalaryoftheEmployeeshallbemonthlypaidbytheEmployerinaccordancewithapplicablelawsandregulationsofP.R.C。ItshallbepaidbylegaltenderandnotlessthanthestandardminimumsalaryinTianjin.b。ThesalaryoftheEmployeeisRMB$______permonthintheprobationaryperiodandRMB$_____aftertheprobationaryperiod.c。Ifthedelayordefaultofsalarytakesplace,theEmployershallpaytheeconomiccompensationexceptthesalaryitselfinaccordancewiththerelevantlawsandregulations.4.WorkingHours&Rest&Vocationa。ThenormalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingmealsandrestforanaverageoffivedaysperweek,foranaverageoffortyhoursperweek.b。TheEmployeeisentitledtoalllegalholidaysandotherpaidleavesofabsenceinaccordancewiththelawsandregulationsofthePRCandthecompany’sworkrules.c。TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandtheEmployee,buttheextendedworkinghourforadayshallgenerallynotexceedonehour;Ifsuchextensioniscalledforduetospecialreasons,theextendedhoursshallnotexceedthreehoursaday.However,thetotalextensioninamonthshallnotexceedthirty—sixhours。5.SocialSecurity&Welfarea.TheEmployerwillpayforallmandatorysocialsecurityprogramssuchpensioninsurance,unemploymentinsurance,medicalinsuranceoftheEmployeeaccordingtotherelevantgovernmentandcityregulations.b。DuringtheperiodoftheContract,theEmployee’s

welfareshallbeimplementedaccordancewiththelawsandrelevantregulationsofP.R。C。6。WorkingProtection&WorkingConditionsa。TheEmployershouldprovidetheEmployeewithoccupationalsafetyandhealthconditionsconformingtotheprovisionsoftheStateandnecessaryarticlesoflaborprotectiontoguaranteethesafetyandhealthduringtheworkingprocess.b.TheEmployershouldprovidetheEmployeewithsafetyeducationandtechniquetraining;TheEmployeetobeengagedinspecializedoperationsshouldreceivespecializedtrainingandacquirequalificationsforsuchspecialoperations.c。TheEmployeeshouldstrictlyabidebytherulesofsafeoperationintheprocessoftheirwork。7.LabourDisciplinea.TheEmployermaydraftbylawsandlabourdisciplinesoftheCompany,Accordingtowhich,theEmployershallhavetherighttogiverewardsortakedisciplinaryactionstotheEmployee;

b。TheEmployeeshallcomplywiththemanagementdirectionsoftheEmployerandobeythebylawsandlabourdisciplinesoftheEmployer.c。TheEmployeeshallundertaketheobligationtokeepandnottodisclosethetradesecretfortheEmployerduringtheperiodofthisContract;

ThisobligationofconfidentialityshallsurvivetheterminationofthisContractforaperiodoftwo

(2)years。8.Termination,Modification,RenewandDischargeoftheContracta。TherelevantclausesoftheContractmaybemodifiedbytheparties:i。Thespecificclauseisrequiredtobemodifiedbythepartiesthroughconsultation;ii.Duetotheforcemajeure,theContractcannotbeexecuted;iii.TherelevantlawsandregulationshavebeenmodifiedorabolishedbythetimeofsigningtheContract。b.TheContractmaybeautomaticallyterminated:i)ThisContractisnotrenewedattheexpirationofthisContract;ii)TheEmployerislegallyannouncedtobebankruptcy,dismissed,orcanceled;iii)Thedeathofthe

Employeeoccurs;iv)Theforcemajeuretakesplace;v)TheconditionsofterminationagreedintheContractbythepartiesarise.c.TheContractmayberenewedattheexpirationthroughconsultationbythepartieswiththefulfillmentoftheprocedurewithin15daystotheexpiration;d.TheContractmaybedischargedthroughconsultationbytheparties;e.TheContractmaybedischargedbytheEmployerwithimmediateeffectandtheEmployeewillnotbecompensated:i。TheEmployeedoesnotmeetthejobrequirementsduringtheprobationaryperiod;ii。TheEmployeeseriouslyviolatesdisciplinesorbylawsoftheEmployer;iii.TheEmployeeseriouslyneglectshisduty,engagesinmalpracticeforselfishendsandbringssignificantlosstotheEmployer;iv。TheEmployeeisbeingpunishedbyphysicallabourforitsmisfeasancev。TheEmployeeisbeingchargedwithcriminaloffences:f.TheContractmaybeterminatedbytheEmployerbygivingnoticeinwrittenform30(thirty)daysinadvance:i。TheEmployeefailsillorisinjuredto(otherthanduetowork)andaftercompletionofmedicaltreatment,isnotabletoperformhispreviousfunctionoranyotherfunctiontheEmployerassignstohim;ii。TheEmployeedoesnotshowsatisfactoryperformanceandaftertrainingandadjustingmeasuresisstillnotabletoperformsatisfactorily;iii.ThecircumstanceshavemateriallychangedfromthedatethisContractwassignedtotheextentthatitisimpossibletoexecutetheContractprovided,however,thatthepartiescannotreachanagreementtoamendthecontracttoreflectthechangedcircumstances.iv。TheEmployerisbeingconsolidatedinthelegalconsolidationperiodonthebrinkofbankruptcyorthesituationofbusinessisseriouslyintrouble,undersuchcondition,itisrequiredtoreducetheemplouee.(inlegalprocedure)g。TheEmployeeshallnotbedismissed:i.TheContracthasneitherexpirednorconformedto8。d,8。e,8。f,8.g;ii。TheEmployeeisillwithoccupationaldiseaseorinjuredduetoworkandhasbeenauthenticatedfullyorpartlydisabledbytheLabourAuthenticationCommissioninBaodiCounty,Tianjin。iii.TheEmployeeisillorinjured(otherthanduetowork)andiswithintheperiodofmedicalleaveprovidedforbyapplicablePRClawandregulationsandCompanypolicy;iv。TheEmployeeiswomanwhoispregnant,onmaternityleave,ornursingababyunderoneyearofage;oriii.TheapplicablePRClawsandregulationsotherwiseprohibittheterminationofthisContract.h。TheContractmaybedichargedbytheEmployeebygivingnoticeinwrittenform30(thirty)daysinadvance.However,theEmployeemayinformtheEmployertodischargetheContractatrandomunderthefollowingoccasions:i.TheEmployeeisstillintheprobationaryperiod;ii。TheEmployerforcetheEmployeetoworkbyviolence,duressorillegalrestrictiontophysicalfreedom;iii.TheEmployerdoesnotpaytheremunerationoftheEmployeeaccordancewiththerelevantclauseintheContract;iv.TheEmployerviolatestherelevantregulationsofStateorTianjinforitsterriblesafeandhealthcondition,whichisharmfultotheEmployee’shealth。I。TheContractcannotbeterminatedbytheEmployeebeforetheexpirationifnotconformingto8.d,8.h,j。TheEmployershallpay

theeconomiccompensationtotheEmployeriftheContractisterminatedconformingto8.d,8.f,8.h。i—8.h。iv.AdditionalfeeformedicalallowanceshouldbepaidtotheEmployeeiftheContractisterminatedconformingto8。f。i.9。BreachLiabilitiesa。Duetoeitherparty'sfault,ifbreachingtheContract,thatpartyshallundertakethebreachliabilityaccordingtotheextenttotheperformanceoftheContract;ifthepartiesbothbreachtheContract,theyshallundertakeitsseparateliabilityaccordingtotheconcretesituation.b.Duetoeitherparty’sfault,ifbreachingtheContracttodamagetheotherparty.ThedamageshouldbecompensatedbythefaultypartyaccordancewiththerelevantlawsandregulationsofPRC。c.Duetotheforcemajeure,causingthenon-performanceorthedamagestoeitherparty,theotherpartymaynot

undertakethebreachliability;c.TheEmployeewantstoresignandhasreceivedtraining

providedbytheEmployer,theEmployeeshallcompensateforthetrainingcost。Themethodofcompensationshouldbefixedaccordingtotherelevantcompanyregulationsasfollows:TheEmployeeshallcompensateRMB_______within___year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallcompensateRMB_______within___year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallcompensateRMB_______within___year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;10。LaborDisputesWherealabordisputebetweenthepartiestakesplaceduringtheperformanceofthisContract,theparties
