1、Welcome!,中國出入境邊防檢查法律法規(guī)： Regulations of the Peoples Republic of China on Exit and Entry Frontier Inspection 第二章 人員的檢查和管理 Chapter II Inspection and Control of Persons,第七條 出境、入境的人員必須按照規(guī)定填寫出境、入境登記卡，向邊防檢查站交驗(yàn)本人的有效護(hù)照或者其他出境、入境證件（以下簡稱出境、入境證件），經(jīng)查驗(yàn)核準(zhǔn)后，方可出境、入境。 Article 7 For exit from or entry into China, perso

2、ns shall fill in arrival or departure cards in accordance with the relevant regulations and present to the frontier inspection stations for examination their valid passports or their exit or entry documents (hereinafter referred to as exit-entry documents); they may leave or enter the country after

3、the frontier inspection stations have examined and approved their documents.,第八章出境、入境的人員有下列情形之一的，邊防檢查站有權(quán)阻止其出境、入境： （一）未持出境、入境證件的； （二）持有無效出境、入境證件的； （三）持用他人出境、入境證件的； （四）持用偽造或者涂改的出境、入境證件的； （五）拒絕接受邊防檢查的； （六）未在限定口岸通行的； （七）國務(wù)院公安部門、國家安全部門通知不準(zhǔn)出境、入境的。 （八）法律、行政法規(guī)規(guī)定不準(zhǔn)出境、入境的。 出境、入境的人員有前款第（三）項(xiàng)、第（四）項(xiàng)或者中國公民有前款第（七）項(xiàng)

4、、第（八）項(xiàng)所列情形之一的，邊防檢查站可以扣留或者收繳其出境、入境證件。,Article 8 The frontier inspection stations have the power to forbid persons belonging to any of the following categories to leave or enter the country: (1) failing to hold exit-entry documents; (2) holding and using invalid exit-entry documents; (3) holding and u

5、sing exit-entry documents other than their own; (4) holding and using forged or altered exit-entry documents; (5) refusing to accept frontier inspection;,(6) failing to pass through the ports as designated; (7) being forbidden to leave or enter the country under the notice of the public security dep

6、artment or the state security department of the State Council; or (8) being forbidden to leave or enter the country in accordance with laws and administrative regulations. The frontier inspection station may detain or confiscate the exit-entry documents of the persons defined in the item(3) or (4) a

7、bove or of the Chinese citizens defined in the item(7) or（8） above,第五章 處罰 第三十一條 對違反本條例規(guī)定的處罰，由邊防檢查站執(zhí)行。 第三十二條 出、入境的人員有下列情形之一的，處以550元以上2000元以下的罰款或者依照有關(guān)法律、行政法規(guī)的規(guī)定處以拘留： （一）未持出境、入境證件的； （二）持用無效出境、入境證件的； （三）持用他人出境、入境證件的； （四）持用偽造或者涂改的出境、入境證件的。,Chapter V Penalties Article 31 Penalties for any contravention of

8、 these Regulations shall be ruled by frontier inspection stations. Article 32 Any person leaving or entering the country who is under any of the following circumstances shall be fined 500 to 2000 Yuan or detained in accordance with relevant laws and administrative regulations:,(1) failing to hold ex

9、it-entry documents; (2) holding and using invalid exit-entry documents; (3) holding and using exit-entry documents other than his own; (4) holding and using forged or altered exit-entry documents.,第三十三條 協(xié)助他人非法出境、入境，情節(jié)輕微尚不構(gòu)成犯罪的，處以2000元以上10000元以下的罰款，有非法所得的，沒收非法所得。 Article 33 Any person who assists oth

10、er persons to illegally leave or enter the country shall be fined 2000 to 10000 Yuan if the circumstances of the case are not serious enough to constitute a crime; and the illegal income, if any, shall be confiscated.,第三十四條 未經(jīng)批準(zhǔn)攜帶或者托運(yùn)槍支、彈藥出境、入境的，沒收其槍支、彈藥，并處以1000元以上5000元以下的罰款。 Article 34 Any person w

11、ho carries or consigns firearms or ammunition out of or into the country without approval shall be fined 1000 to 5000 Yuan with all the firearms and ammunition confiscated.,第三十五條 有下列情形之一的，處以警告或者500元以下罰款： （一）未經(jīng)批準(zhǔn)進(jìn)入口岸的限定區(qū)域或者進(jìn)入后不服從管理，擾亂口岸管理秩序的； （二）污辱邊防檢查人員的； （三）未經(jīng)批準(zhǔn)或者未按照規(guī)定登陸、住宿的。,Article 35 Any person

12、who is under any of the following circumstances shall be given a warning or punished with a fine not exceeding 500 Yuan: (1) entering restricted areas in ports without permission or after his entry, disobeying administration or disturbing the port administration order; (2) insulting frontier inspect

13、ors; or (3) landing or lodging without permission or not in compliance with relevant regulations.,第四十條 邊防檢查站執(zhí)行罰沒款處罰，應(yīng)當(dāng)向被處罰人出具收據(jù)。罰沒款應(yīng)當(dāng)按照規(guī)定上繳國庫。 Article 40 The frontier inspection stations shall furnish the penalized person with a receipt upon receiving the fine. The fine and money confiscated shall b

14、e turned over to the state treasury according to regulations.,第四十一條 出境、入境的人員違反本條例的規(guī)定，構(gòu)成犯罪的，依法追究刑事責(zé)任。 Article 41 Any person leaving or entering the country who has violated the provisions of these Regulations, criminal responsibility shall be investigated according to law if the circumstances of the

15、case are serious enough to constitute a crime.,第四十二條 被處罰人對邊防檢查站作出的處罰決定不服的，可以自接到處罰決定書之日起15日內(nèi)，向邊防檢查站所在地的縣級公安機(jī)關(guān)申請復(fù)議；有關(guān)縣級公安機(jī)關(guān)應(yīng)當(dāng)自接到復(fù)議申請書之日起15日內(nèi)作出復(fù)議決定；被處罰人對復(fù)議決定不服的，可以自接到復(fù)議決定書之日起15日內(nèi)，向人民法院提起訴訟。,Article 42 If a person refuses to accept the penalty decision made by a frontier inspection station, he may, within 15 days from his receipt of the penalty decision, apply for reconsideration to the public security organ of the county level in the locality of the frontier inspection station.
