WorksPeriod1、開工日期：以乙方接到甲方書面開工通知之日為開工日期。CommencementDateisthedayonwhichpartyBisinformedwithpartyAnoticeofcommencingworks.

’swrittennotic3使用期限：甲方使用乙方鋼管腳手架工期為 個月（自乙方接到甲方書面通知開始搭設(shè)之日起至甲方書面通知拆架全部完畢之日計(jì)算）。UsePeriodlimited:WorksperiodduringwhichpartyAusethesteelpipescaffoldingwhichbeingfixedbypartyBwillbemonthsonandfromthedateofreceiptofpartyA ’swrittennoticeforcommencementoffixingscaffoldtothedateofdismantlingallscaffoldunderpartyA ’swrittennotice.4、施工工期以工程開工日期至竣工日期計(jì)算。Projectperiodiscalculatedfromthedayofcommencementtothedayofcompletion.5、工期延誤：WorksDelay①如果因?yàn)橐曳皆?，工期達(dá)不到要求，乙方應(yīng)向甲方支付違約金，每延誤一天，違約金為元整;ProvidedthatifworksperiodfailtosatisfyandmeettherequirementofcontractduetopartyB’sreason,partyBshouldbepunishedtopayliquidateddamagestopartyA,thepaymentofdamagesisYuanforeachdelayedday.②乙方在接到甲方通知拆架時，必須按雙方協(xié)商的時間內(nèi)組織拆除完成，否則視為拖延工期。PartyBshould,uponreceiptofpartyA’snoticeofdismantlement,withintheagreedtime,completethedismantlementofscaffold,otherwise,shallbedeemedasworksdelay.四、工程質(zhì)量：ProjectQuality1、乙方搭設(shè)的外墻鋼管腳手架必須精心組織施工，工程質(zhì)量達(dá)到合格等級。PartyBshouldwell-organizeexecutionofsteelscaffoldontheexternalwallsoastoreachthequalifyinggrade.2、乙方提供的鋼管，必須是具有生產(chǎn)資質(zhì)的廠家生產(chǎn)的產(chǎn)品，進(jìn)場時，乙方應(yīng)向甲方提供產(chǎn)品合格證。ThesteeltubewhichisprovidedbypartyBshouldbetheproductsmadebythequalifiedmanufactureandatthetimeenteringthesitepartyBshouldissuetheproductcertificationtherewithtopartyA.3、乙方搭設(shè)的外墻鋼管腳手架應(yīng)隨時接受甲方、監(jiān)理工程師的檢查、監(jiān)督，對工程質(zhì)量達(dá)不到合格標(biāo)準(zhǔn)的部分，乙方應(yīng)按甲方、監(jiān)理工程師的要求返工、修改或重新搭設(shè)，并承擔(dān)返工、修改或重新搭設(shè)的費(fèi)用。TheworksofsteelscaffoldonexternalwallundertakenbypartyBshouldatanytimeaccepttheinspectionandsupervisionofpartyA,theengineer.Respectingtoanynon-qualifiedpartofworks,partyBshouldbytherequirementofpartyAandtheengineerrework,modifyorre-setupandbearthecorrespondingcostthereof.4、質(zhì)量應(yīng)符合建設(shè)部頒布的《鋼管腳手架扣件》（國家標(biāo)準(zhǔn) GB15831-2006）的規(guī)定。QualityshouldconformwiththestipulationsofPIPESCAFFOLDFASTENERissuedbyMinistryofConstruction(State standard’sGB15831-2006).五、工程款的價格與支付 PriceandPayment一、單價UnitPrice1、外墻鋼管腳手架基礎(chǔ)價每平方米 元：Thebasepriceof Yuanpersquaremeterforsteelscaffoldonexternalwall基礎(chǔ)價 元×總月數(shù)（暫按 5個月計(jì)）Thebasepriceof Yuan ×totalmonths(temporaryasfivemonths)2、塔吊、卸料平臺搭、拆每個每次 元。Yuanforeachtimeoffixingordismantlingoftowercraneandflatformaterialdischarge.3、各樓層樓梯、電梯等出入口的欄桿、防護(hù)欄搭拆每延長米 元。Yuanforeachextendmeteroffixingordismantlingofrailingandguardfenceontheentrance/exitofstairs,elevatorandotheroneachfloor.二、工程價款的支付與結(jié)算： SettlementandPayment1、工程進(jìn)度款的支付： Progresspayment①鋼管腳手架的工程進(jìn)度款（含延期款）按月以現(xiàn)金形式支付乙方。PaymentofprogressincludingextensionforthesteelscaffoldshallbeeffectedtopartyBincashonamonthly.②每月工程量由乙方在下月

WorkQuantityandPaymentSettlementA工程量的計(jì)算： CalculationofWorkQuantity1）外墻鋼管腳手架：總搭設(shè)面積=（外墻周長+陽臺+凸窗+空調(diào)板+聯(lián)系梁延長兩邊+各加四個轉(zhuǎn)角每按4米計(jì)算）×實(shí)際搭設(shè)總高度（至最高一層防護(hù)欄桿頂）計(jì)算面積，井架出料平臺。如果為雙排架則按雙倍計(jì)算面積，若為單排架則按 1.5倍計(jì)算面積。Steelscaffoldonexternalwall:Totalfixingarea=(externalwallperimeter+balcony+baywindow+airconditioningboard+extendingsidesofcontactbeamadding4cornersforwhich,eachcorneras4meters)×totalheightoftheactualinstallation(tothehighestlayerofprotectiverailingtop),andcalculationoftotalareaandtheunloadingplatform.Respectingdoubleshelve,thedoublecostwillbecounted;wheresingleshelve,the1.5timesareawillbecounted.2）塔吊卸料平臺、防護(hù)棚、操作棚、平網(wǎng)懸挑：按搭設(shè)的卸料平臺及防護(hù)棚和操作棚、平網(wǎng)懸挑的長度乘以寬度計(jì)算面積。Quantityoftowercrane,unloadingplatform,protectiveshed,operatingshedandsuspendednet:Calculationofareaissubjectto（3）槽鋼懸挑按實(shí)際搭設(shè)槽鋼懸挑的墻面延長周長計(jì)算延長米。Extendingmetersofchannelsteelsuspensionwillbecalculatedontheextendingperimeterofwallonwhichchannelsteelsuspensionbeingfixed.4）外墻鋼管腳手架、卸料平臺、防護(hù)棚、操作棚、各樓層樓梯、電梯洞口防護(hù)、槽鋼懸挑、平網(wǎng)懸挑等工程量的款項(xiàng)應(yīng)在拆除前全部結(jié)清，否則乙方有權(quán)利拒絕拆除，由此造成延長工期時間計(jì)算為甲方使用乙方鋼管腳手架期限。Allworkscostofwallsteelpipescaffolding,unloadingplatform,protectiveshed,operatingshed,fenceofelevatorentrance,channelsteelsuspensionandsuspendednetshouldbepaidoff,otherwisepartyBisentitletorefusetodismantle,theextensionofworktimetheretoshallbecalculatedintotheperiodlimitedduringwhichpartyAusepartyB ’ssteelscaffolding.六、各方安全責(zé)任： SafetyResponsibilitiesofEachParty乙方施工期間對安全生產(chǎn)承擔(dān)全部責(zé)任。乙方應(yīng)確保施工安全，如施工時發(fā)生安全事故，其經(jīng)濟(jì)責(zé)任、法律責(zé)任概由乙方承擔(dān)。PartyBshouldduringconstructionassumefullresponsibilitiesforexecutionsafety.PartyBshouldensurework’ssafety,whereandifanyaccidentconcernedsafety,anyandallliabilitiesofeconomyandlegaltheretoshallbeundertakenbypartyB.乙方搭設(shè)完后經(jīng)甲方驗(yàn)收合格，施工中使用腳手架的安全責(zé)任由甲方負(fù)責(zé)，甲方不經(jīng)乙方同意不得擅自拆除加固點(diǎn)等，否則發(fā)生安全事故，經(jīng)濟(jì)責(zé)任、法律責(zé)任概由甲方承擔(dān)。FixingofscaffoldingwilluponcompletionbypartyB,beacceptedbypartyA.ThesafetyresponsibilityduringusingforconstructionbypartyAshallbeundertakenbypartyAitselfwhichcannotremovethereinforcedjointwithoutpartyB’sconsent,otherwise,anyandallliabilitiesofeconomyandlegaltheretoshallbeundertakenbypartyA.七、禁止轉(zhuǎn)包與分包： NoSubcontract乙方不得擅自將其承包的全部工程轉(zhuǎn)包給他人，也不得擅自將其承包的工程肢解后以分包的名義分別轉(zhuǎn)包給他人，否則，甲方有權(quán)單方終止合同。PartyBshouldnotbeallowedtosubcontractatitsowninitiativeallprojectwhichiscontractedbyitself,neithermakedismembermentofprojectwhichiscontractedbypartyBintoseveralpartswhicharesubcontractedtootherpartyrespectively,otherwisepartyAisentitletounilaterallyterminatecontract.八、雙方一般權(quán)利和義務(wù) GeneralRightsandLiabilities（一）甲方義務(wù)： PartyA ’sLiabilities、負(fù)責(zé)現(xiàn)場質(zhì)量檢查、監(jiān)督，對乙方存在的質(zhì)量問題、安全隱患有權(quán)提出整改意見，并要求乙方進(jìn)行整改。ResponsiblefortheinspectionandsupervisionofqualityonsiteandputforwardtheopinionsofrectificationandcorrectionforqualitydefectiveduetopartyBinadditiontosecurityrisksandrequirementofrectificationandcorrectionbypartyB.2、負(fù)責(zé)協(xié)調(diào)乙方與其他各施工單位的合作關(guān)系，保證乙方正常施工。ResponsibleforcoordinatingthecooperationbetweenpartyBandotherworkingcompaniessoastoensurepartyB ’snormalconstruction.3、負(fù)責(zé)向乙方提供預(yù)埋鋼筋作外架與墻體加固聯(lián)結(jié)及懸挑用。ProvidepartyBwithembeddedreinforcingsteelwhichbeingusedforthelinkageoutsidescaffoldonwallandforsuspension.4、負(fù)責(zé)腳手架基礎(chǔ)地坪的混凝土澆筑及保證其質(zhì)量合格并達(dá)到要求。Responsibleforconcretepouringoffoundationgroundonwhichscaffoldwillfixandensureitsqualityqualifyingandmeettherequirements.5、甲方施工使用架子時，不得隨意破壞連墻點(diǎn)和加固設(shè)施、腳手架上的荷載不得超過200kg/m2 ，上下腳手架堆物不得超過 50kg/m2，否則造成連墻點(diǎn)被毀，頂撐脫落，架子失穩(wěn)等而造成的安全事故責(zé)任由甲方負(fù)責(zé)。PartyAshouldnot,atthetimeofusingscaffoldduringworking,destroyatwillthewalljointandreinforcedfacilities.Theloadonscaffoldshallnotbeexceedover200kg/m2andmaterialpileupanddownscaffoldshallnotexceedover50kg/m2,otherwiseanysecurityaccidentincludingdestructionofwalljoint,peakfallandshelveinstabilityshallbeliabilityonpartyA.6、負(fù)責(zé)及時撥付工程進(jìn)度款，為乙方正常施工無償提供場地條件及垂直運(yùn)輸機(jī)具。EffectthepaymentofprogresscostintimeandprovidepartyBinfreewiththesiteconditionsandtheverticaltransportequipment.（二）乙方義務(wù)： PartyB ’sLiabilities1、履行甲方通知、監(jiān)理指令及有關(guān)部門的行政命令等文件所要求的責(zé)任和義務(wù)，并按要求責(zé)任具體實(shí)施。FulfillmentofpartyA’snoticeandsupervisiondirectioninadditiontotheliabilitiesandobligationsunderdecreesofthecompetentauthoritiesandimplementationofparticularresponsibilitiesuponrequirements.2、乙方必須對施工技術(shù)、工程質(zhì)量、安全生產(chǎn)、文明施工進(jìn)行嚴(yán)格的規(guī)范管理并規(guī)范施工。PartyBshouldmakestrictlystandardmanagementofexecutiontechnology,projectquality,safetyproductionandorderlyconstruction,aswellasmakingnormativeimplementationofproject.九、違約Default本合同一經(jīng)簽訂，即產(chǎn)生法律效力，任何一方均不得違約，否則，違約方應(yīng)賠償對方得經(jīng)濟(jì)損失和承擔(dān)所引起得法律責(zé)任。Thiscontractwillcomeintoforceandeffectuponsignaturehereof,whichanypartycannotbreach,otherwisethebreachpartyshouldcompensatetheoppositeparty’seconomiclossandundertakelegalliabilityarisingorresultingtherefrom.十、爭議Disputes如果雙方在履行合同時發(fā)生爭議，可以和解或者請求有關(guān)主管部門調(diào)解，當(dāng)事人不愿和解、調(diào)解或者和解不成的，雙方可向本合同簽訂地管轄權(quán)的仲裁機(jī)構(gòu)提起仲裁申請。Providedthatifanydisputeoccurredduringimplementationofcontract,partiesheretomaytakeconciliationorapplytothecompetentauthorityformediationthereon,if,anypartyreluctanttoorfailureofconciliationandmediation,mayissuetheapplicationofarbitrationtothearbitrationauthoritywhichontheplaceofsignature.十一、不可抗力 ForceMajeure如果合同一方由于不可抗力因素而不能履行合同，比如地震、臺風(fēng)、洪水、火災(zāi)、戰(zhàn)爭及其他無法預(yù)見的事件，其發(fā)生和后果也無法阻止、無法避免的，該方應(yīng)立刻以電報(bào)通知對方，并在其后十五天內(nèi)提交公證機(jī)關(guān)出具的詳細(xì)的事件描述及有效文件，用以解釋其無法履行合同全部或部分條款的原因。雙方應(yīng)通過協(xié)商，根據(jù)事件對履行合同的影響程度，確定是終止合同或是免除履行合同的責(zé)任，或延長合同的履行。Shouldeitherofthepartiestothecontractbepreventedfromexecutingthecontractbyforcemajeure,suchasearthquake,typhoon,flood,fireandwarandotherunforeseeneventsandtheirhappeningandconsequencesareunpreventableandunavoidable,thepreventedpartyshall,bycable,notifytheotherpartywithoutanydelay,andshall,within15daysthereafter,providethedetailedinformationoftheeventsandavaliddocumentforevidenceissuedbytherelevantpublicnotaryorganizationforexplainingthereasonofitsinabilitytoexecuteordelaytheexecutionofallorpartofthecontract.Thepartiestothecontractshall,throughconsultations,inaccordancewiththeeffectsoftheeventsontheperformanceofthecontract,decidewhethertoterminatethecontractortoexemptthepartofobligationsforimplementationofthecontractorwhethertodelaytheexecutionofthecontract.十二、其他約定 落地式雙排鋼管腳手架Basedonthearchitecturalfigureandstructuralformofthisengineering,inthecourseofconstruction,Bi-rowlandingsteel-pipescaffoldshallusedintheproject,andsuchscaffoldschemewillbeexecutedasfollows:根據(jù)本工程建筑造型、結(jié)構(gòu)形式，在本工程結(jié)構(gòu)和裝飾階段施工中擬采用落地式雙排鋼管腳手架，腳手架施工方案具體如下：Stageofbasement 基礎(chǔ)階段：All-closed,landing,steel-pipeandbi-rowscaffoldshallbeputupalongtheperipheryofthebasement.Ifnecessary,internalscaffoldwillbebuilt.地下室外圍搭設(shè)雙排全封閉落地鋼管腳手架，內(nèi)腳手根據(jù)需要搭設(shè)。Stageofbasebuilding 裝修階段：Externalscaffold:thescaffoldusedinmainbody. 外腳手架：利用主體結(jié)構(gòu)腳手架。Internalscaffoldwillbeputupifnecessary.
